
Haz Waste/New Used Oil Statute
In contrast to federal and most states’ hazardous waste regulations, California used oil generators have typically had to manage their used oil as a fully regulated hazardous waste. Finally, some relief: California’s Assembly Bill 2928 amended Section 25250.19 of the California Health and Safety Code to allow generators of “highly controlled used oil” to manage the oil as a non-hazardous waste effective January 1, 2019. However, while some generators have charged ahead, many more either don’t know about the changes, or are awaiting guidance from the Department of Toxic Substances Control (DTSC) or their local Certified Unified Program Agency (CUPA) as to how exactly the statutory requirements are being interpreted. Such guidance has so far not been forthcoming. This webinar will review who is eligible to manage their used oil as non-hazardous, the requirements that must be met to do so, and the key uncertainties that may be leading to hesitancy in many cases.
