California Air Permitting: Requirements, Process, and Key Considerations

Overview of California Air Permitting

California air permitting is the regulatory framework that governs how facilities construct, modify, and operate equipment that emit air pollutants. Permits are issued by local Air Quality Management Districts (AQMDs) and Air Pollution Control Districts (APCDs) under authority from the California Air Resources Board (CARB) and the federal Clean Air Act.

The primary goal of air permitting is to ensure that emissions are evaluated, controlled, and monitored to protect public health and maintain compliance with State and federal air quality standards.

When Air Permits Are Required

Air permitting requirements are triggered when equipment or processes have the potential to emit regulated air pollutants. This applies across a wide range of industries, including manufacturing, power generation, solid waste management, sanitation districts, food processing, petroleum operations, construction materials, aerospace, and many other commercial and government operations.

Examples of commonly permitted equipment include:

  • Combustions sources such as boilers, heaters, flares, and process equipment, etc.;
  • Power engines, turbines, and emergency backup generators;
  • Chemical, coatings, anodizing, etc.
  •  Solvent use in operations;
  • Storage tanks; and
  • Material handling systems.

Even relatively small emission sources may require a permit depending on local air district rules and emissions thresholds.

Types of Air Permits in California

Authority to Construct (ATC)

An Authority to Construct (ATC) is required before installing or modifying equipment. The Air District evaluates:

  • The magnitude of emissions per source and project;
  • Applicability of district rules; and
  • Required control technologies, including Best Available Control Technology (BACT).

This step ensures that emissions are addressed before a project is built.

Permit to Operate (PTO)

After construction, facilities must obtain a Permit to Operate (PTO). This confirms that equipment has been installed in accordance with permit conditions and can operate in compliance with applicable regulations. In some situations, source testing is required prior to the issuance of the PTO.

Title V Operating Permit

Facilities classified as major sources must obtain a Title V permit. These permits consolidate all applicable requirements into a single operating document and include permit conditions including the following as examples:

  • Monitoring, such as source testing, continuous electronic monitoring, observational, and measurements;
  •  Reporting obligations for criteria and toxic emissions;
  • Recordkeeping requirements, often for throughput by source or other key operational parameters; and
  • Semi-annual and annual compliance certifications, etc.

Key Elements of the Air Permitting Process

While requirements vary by air district and project, most air permitting efforts involve several core steps:

Applicability Determination

The first step is determining whether a project requires a permit. This depends on equipment type, emissions potential, and district-specific rules. In California, there are exemptions at all air districts and de-minimums exemptions in some.

 Emissions Evaluation

Facilities must quantify emissions for:

  • Criteria pollutants [e.g., nitrogen oxides (NOx), volatile organic compounds (VOCs), particulate matter (PM)];
  • Toxic air contaminants (TACs); and
  • Greenhouse gases (GHGs), where applicable.

This analysis forms the technical basis of the permit application.

 Application Development

Permit applications typically include:

  • Equipment specifications;
  • Process descriptions, including throughputs and specific steps;
  • Emission calculations; and/or
  • Proposed control measures, usually required as BACT in California.

The level of detail required can be substantial, particularly for complex projects.

 Agency Review

Air districts evaluate applications for compliance with applicable regulations, including:

  • New Source Review (NSR) requirements;
  • BACT determinations; and
  • Air quality impacts, such as toxic health risk assessments that require air dispersion modeling.

Some projects may require public notice or additional environmental reviews such as U.S. EPA Title V review and CEQA approval.

 Permit Conditions and Compliance

Issued permits include enforceable conditions such as:

  • Emission limits;
  • Monitoring requirements;
  • Operational restrictions; and
  • Recordkeeping and reporting obligations.

Ongoing compliance with these conditions is required to maintain good standing with regulatory agencies.

 

Why the Process Is Often Challenging

California’s air permitting framework is widely recognized as one of the most stringent in the United States. Challenges frequently arise from:

  • Variation in rules across the 35 air districts;
  • Rule applicability and rule analysis can be difficult, especially since the interpretation can be in unpublished air district policies;
  • Highly detailed technical and emission calculation requirements with and without control devices;
  • Toxic health risk assessment (HRA) modeling;
  • Evolving regulatory programs (e.g., air toxics, GHG reporting); and
  • Coordination with federal requirements such as Title V, and CARB toxic requirements.

Because of this complexity, many facilities perform air permit  feasibility studies early in the process to understand the permitting requirements prior to detailed design and purchasing equipment.

 

Practical Considerations for Businesses

Organizations planning new projects or modifications should consider:

  • Evaluating permit requirements early in the design phase;
  • Identifying district-specific rules that may affect feasibility;
  • Allowing sufficient time for agency review and approvals; and/or
  • Ensuring internal resources or external expertise are available to manage technical requirements.

Proactive planning is often the most effective way to avoid delays and regulatory complications.
