Professional Engineer (P.E.)-Certified SPCC Plans
PE Certified SPCC Plans are required for 40 Code of Federal Regulations (CFR) 112.1 regulated facilities with aggregate aboveground storage capacity of oil greater than 10,000 gallons and a reasonable threat of discharge of oil into or upon navigable waters of the U.S.; as well as for facilities with greater than 1,320 gallons of oil that do not meet the Tier 1 or Tier II applicability criteria under 40 CFR 112.6. Only containers with a capacity of 55 gallons or greater are counted.
In California, aforementioned facilities with no threat of discharge to navigable water and an aboveground petroleum storage capacity of 10,000 gallons or more, as well as for facilities with petroleum storage of 1,320 gallons of more of oil that do not meet the Tier 1 or Tier II applicability criteria under 40 CFR 112.6, are required to have a P.E.-certified SPCC plan.
SPCC regulations under 112.5 also require that SPCC plans be amended within 6 months of a change in facility design, construction, operation, or maintenance that materially affects its potential for discharge. Technical amendments require a P.E. certification. Additionally, owner/operators must complete a review and evaluation of their SPCC plan every 5 years and amend the plan to include more effective prevention and control technology.
